Registered Voter Petition for Proceedings Pursuant to the

Cortese-Knox-Hertzberg Local Government Reorganization

Act of 2000 to Incorporate the City of Wildomar

 

 

The undersigned hereby petition the Riverside Local Agency Formation Commission for approval of a proposed reorganization and stipulate as follows:

 

1.      This proposal is made, and it is requested that proceedings be taken, pursuant to Part 3, Division 3, Title 5 of the California Government Code (commencing with Section 56650, Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000).

 

2.      The specific changes or organization proposed are:

 

  1. Incorporation of a new city.
  2. Detachment from County Service Areas 103 and 152.

 

3.      The boundaries of the territory included in the proposal are described in Exhibit A attached hereto and by this reference incorporated herein.

 

4.      The territory included in the proposal is inhabited.

 

5.      This proposal is not consistent with the spheres of influence of the affected districts and it is requested that the spheres be modified to be consistent with this proposal.

 

6.      The reasons for the proposal are to (a) provide Wildomar residents local control over planning, services and infrastructure, (b) provide the local community a greater voice in regional issues; (c) create an efficient and politically accountable local government for our community; (d) retain local tax revenues for use in and to benefit the community; (e) enhance the quality of life and maintain our community’s unique environment and (f) preserve Wildomar’s historical and cultural heritage.

 

7.      The proposal is requested to be made subject to the following terms and conditions:

 

  1. Single Ballot Question – The question of incorporation, all related boundary changes, and all terms and conditions shall be presented as one question on the ballot.

 

  1. Name – This City shall be the City of Wildomar.

 

  1. Effective Date – The effective date of the incorporation shall be November 12, 2004 or as soon thereafter as possible.

 

  1. Legislative Body – The City shall be governed by a 5-member City council elected at large.

 

  1. Future Elections of City Council Members – The election to confirm the question of the incorporation shall present the question of whether the members of the City Council in future elections shall be elected by division or at-large.

 

  1. Council Terms of Office – The terms of office of the City Council members shall be four years.  Of the first elected legislative body, the terms of the 3 members of the City Council with the largest popular vote shall be 4 years.  Of the first elected legislative body, the terms of the 2 members of the City Council with the least popular vote shall be 2 years.

 

  1. Selection of Mayor – It is the desire of the electorate that the terms of office of Mayor be one year and that the position be rotated among all members of the City council.  It is intended that the City council candidate receiving the greatest number of votes during the incorporation election shall serve as the first Mayor of the City, followed by the candidate who receives the next highest number of votes, and so forth, provided that in no instance shall a member of the City Council serve a second term as Mayor until all originally elected members have served a first term.

 

  1. First City Council Meeting – In addition to all other means authorized by law, the first meeting of the City council may be called by notice given in a lawful manner by any three members of the City Council.

 

  1. Form of Organization – The City shall have a city manager and the City Council shall appoint the city manager who shall fill the positions of city clerk and city treasurer by appointment.

 

  1. Provisional Appropriations Limit – LAFCO shall establish a provisional appropriations limit sufficient to accommodate reasonable and possible future increases in proceeds of taxes received by the City.

 

  1. Continuation of Existing General Taxes – The City shall be authorized to levy as general taxes of the City those general taxes which are from time to time levied by the County including (1) a sales and use tax collected under contract with the State Board of Equalization and returned to the City pursuant to applicable law, (2) a transient occupancy tax on gross receipts of hotels, motels, and similar facilities within the City and returned by the operators of such facilities pursuant to local ordinance, (3) a business license tax to be collected by the City pursuant to local ordinance, and (4) all other applicable general taxes presently imposed by the County to be collected by the same method of collection as used by the County.

 

  1. Continuation of Charges, Fees, and Assessments – The City shall be authorized to continue to levy charges, fees and assessments of the City that are from time to time levied by the County or any of the subject agencies of this incorporation.

 

  1. Transfer of County Assets

 

(1)    On the date of incorporation, or as soon thereafter as practicable, the County shall transfer to the City a proportionate share of all assets, physical and personal, monies or funds, including cash on hand and monies due but uncollected, of the County and of County-governed districts for which services the City will become responsible after incorporation, said share to be determined by LAFCO based upon its evaluation.

 

(2)    On the date of incorporation, or as soon thereafter as practicable, County-owned properties and other physical assets situated within the incorporation area shall be transferred to and become the property of the City without payment or compensation by the City to the County, said assets to be determined by LAFCO based upon its evaluation.

 

8.      The persons signing this petition have signed as Registered Voters.
